Purchase & Delivery Terms

Svenskt Tenn's Purchase and delivery terms in respect of deliveries to consumers.

AREA OF APPLICATION

These purchase and delivery terms, hereinafter called the Terms, apply when any business customer ("the Customer") purchases products from Svenskt Tenn AB, corporate ID number 556032-0375.

In the event of any differences between the Customer's own general terms for the purchase of products and these Terms, these Terms shall have preferential right of interpretation.

Deviations from or changes to these Terms must be in writing and signed by authorised representatives of both Parties to be valid.

ORDERS

Orders must be placed via the website or through Svenskt Tenn's Customer Service.

When the Customer orders via the website and clicks on the purchase button, the Customer enters into a contract with Svenskt Tenn and accepts these Terms.

Immediately after the Customer places an order, an order confirmation is sent to the Customer's email address. It is important that the Customer checks that the order confirmation is correct. If the Customer does not receive an order confirmation, if the order confirmation is incorrect in any way or if the Customer wishes to change the order, the Customer must contact us immediately.

In order to simplify any contacts with our Customer Service, we request that the Customer has the order confirmation to hand. In the event of a change to or cancellation of an order after the contract has been entered into, we reserve the right to require full payment of the whole order, as well as any other additional costs incurred for work carried out.

PRICE

Unless otherwise agreed between the Parties, the Customer shall pay the price for the products shown on the Website, including specified costs for carriage, pallets and similar costs which are shown on the order confirmation. Prices on the Website exclude Value Added Tax.

Any charges for VAT and customs duties are to be paid by the Customer. Unfortunately, Svenskt Tenn is unable to inform the Customer of these charges, and the Customer is solely responsible for the administration involved in the importation of the goods and the payment of VAT and customs duties.

Carriage
Prices are stated excluding carriage. The cost of carriage is additional and is to be paid by the Customer.

Payment
For payment through the Website, the Customer can choose from a range of options for payment including debit card, credit card or through invoice and part payment. For payment through invoice and part payment made via Klarna, if you have any questions in respect of the invoice, please contact Klarna directly.

In certain cases, payment can also be made through an invoice from Svenskt Tenn. Unless otherwise agreed between the Parties, the Customer shall pay Svenskt Tenn’s invoice within thirty (30) days from the invoice date. In the event of delayed payment, interest on overdue payment is payable in accordance with the Swedish Interest Act (SFS 1975:635).

For payment by debit or credit card, Adyen B.V. handles all transactions, which are processed under secure encryption and in accordance with strict bank standards. Your card details are sent directly to the bank, and they cannot be read or downloaded by anyone other than your bank.

We use the 3D-Secure security solution for additional validation of certain debit cards. Svenskt Tenn does not apply any additional charges to card payments. For payment by credit or debit card, the amount is charged to your card in the event that your order and payment are implemented immediately.

Security
We provide a safe method of payment at all times. We work in partnership with Adyen B.V. a company which meets the requirements of PCI DSS. All card details and your personal data are encrypted, which means that only authorised persons can gain access to the information. We use the 3D-Secure security solution for additional validation of certain debit cards.

Proviso
We reserve the right to cancel payments where the goods have obviously been incorrectly priced.

NON-STOCK ITEMS

Deposit
In the event of orders of certain non-stock items, the order must be placed through the Website or Customer Service. We reserve the right to charge a deposit of at least 20% of the price of the item for non-stock items.

Production
When an item is subject to special order, we may require the payment of a deposit before we place the production order. This means that the delivery date may be affected in the event that the Customer does not pay the deposit on the agreed date.

We are under no obligation to release the item before it is paid for in full. Consequently, we reserve the right to delay delivery until full payment has been received.

In individual cases, an item ordered may be out of production, or we may be no longer be able to supply it for some other reason. In such cases, we will contact the Customer immediately to discuss a satisfactory solution.

CANCELLATION

If the Customer wishes to cancel an item, we reserve the right to require full payment of the whole order, as well as any other additional costs incurred for work carried out.

DELIVERY

The delivery method, delivery terms, delivery date and cost vary depending on the country and type of item. Products purchased through Svenskt Tenn’s website are delivered only to Sweden and to certain countries within Europe, as well as to the USA, Japan and Australia. For other countries, please contact Customer Service. The Customer selects the required carriage method when the order is placed.

Unless otherwise separately agreed between the Parties, the items will be DAP in accordance with the most recent applicable version of ICC Incoterms. Customs duties and other local charges are to be paid by the recipient.

Delivery date
The order confirmation specifies the expected date of delivery of the items to Svenskt Tenn. The date of delivery to the Customer varies depending on the country and the type of item.
Delivery is normally within 3–5 working days after receipt of the order if the products are in stock.

For furniture, items subject to special order sold via Customer Service, as well as deliveries to countries other than Sweden, other delivery dates apply. Delivery within Sweden normally takes around five – fourteen days. Deliveries within the EU normally take around four weeks, and deliveries outside the EU depend on country of delivery and delivery method. The delivery date will be notified by Customer Service.

Svenskt Tenn reserves the right to change the delivery date. Please note that the delivery date may be postponed if the Customer is late in paying for an item ordered.

Collection in store
If the Customer places an order before 12.00, it will be available for collection in the store at Strandvägen 5, Stockholm, on the next working day after 10.00. The Customer will receive an SMS message when the items are available for collection in the store. The items must be collected in the store within 10 days.

Delivery notification
In certain cases, a delivery notification may be received from the carrier if the Customer provided a mobile phone number and email address when placing the order.

Delay in delivery
In the event of a delivery delay or discrepancy, we will notify the Customer as soon as possible of the reason for the delay and give a new delivery date. We reserve the right to disavow all compensation claims from the Customer in respect of delivery delays. Svenskt Tenn is not liable for delays from the carrier, manufacturer or any other party.

Damage in transit
We have selected carriers that we consider able to ensure high quality in their deliveries. Nevertheless, damage in transit may occur. On receiving delivery, the Customer should examine the item or packaging for any damage. If the item or packaging shows visible damage, the Customer must report this to the carrier immediately or, if the Customer discovers the damage after delivery, report the damage as soon as possible to our Customer Service. In the event of any damage in transit, the Customer must return the consignment to Svenskt Tenn within a reasonable time, but no later than within one (1) week from delivery.

CLAIMS

If a purchased product is defective, a claim may be lodged. In the event that products are defective, Svenskt Tenn shall, at its own expense and at its own discretion, (a) repair the defective products, (b) accept the return of the defective products, or (c) reimburse the Customer for the payments made for the defective products.

If the Customer considers that an item is defective, the Customer must notify Svenskt Tenn of this in writing. The best way for the Customer to register any claim is via our Claim page. Svenskt Tenn is liable only for defects which were notified to Svenskt Tenn within six (6) months from the date on which the Customer became aware, or should have become aware, of the defect.

PROVISO

Svenskt Tenn accepts no liability for loss or damage arising from any obvious clerical or printing errors.

UNCOLLECTED PACKAGES

Delivered packages are kept at our collection point for 14 days from the date of receipt. If the Customer does not collect the package within that timeframe, it will be returned to us. For collection in store, the items must be collected within 10 days.

In the event that a package is not collected, we charge a fee of SEK 250 for a package sent within Sweden, and SEK 350 for a package sent to another country. This corresponds to our costs for carriage, return carriage and handling.

If a Customer is unable to receive a delivery or collect an item, the Customer must contact us to discuss delivery or collection.

If delivery or collection is delayed through the Customer’s failure to receive the item after notification, we have the right to charge for reasonable storage costs and other expenses we may incur.

If delivery or collection does not take place through the Customer's failure to receive the item after notification, we have the right to treat the Customer's failure as a cancellation of the item.

The personal and contact data provided to us in connection with a purchase or other contact is processed with the utmost respect in accordance with the Data Protection Regulation. FORCE MAJEURE

Svenskt Tenn is relieved of its obligation to fulfil a delivery if the proper fulfilment thereof is prevented due to a circumstance outside our control and which we could not reasonably have taken into account when the contract was entered into, and the consequences of which we could not reasonably avoid or overcome, such as industrial disputes, fire, accident, war, official decisions or any other situation outside our control and which materially affects our proper fulfilment of the contract.

CHANGES TO TERMS

Svenskt Tenn reserve the right to change or make additions to these Terms. The latest applicable Terms are always posted on Svenskt Tenn’s website.

DISPUTES

Svenskt Tenn makes every effort to ensure that all our Customers are satisfied. If something has gone wrong, our first response is always to try to reach an agreement with you.

If, despite our best efforts, we are unable to agree, disputes stemming from these Terms will be settled by a Swedish court of general jurisdiction and with the application of Swedish law.
